Anna Beale and Catherine Meenan win in the Court of Appeal in DPP Law Ltd v Greenberg

The Court of Appeal has upheld the Employment Tribunal’s finding of a fair dismissal in DPP Law Ltd v Greenberg, after the original decision was overturned by the EAT. The claimant, a partner in a solicitors’ firm, was dismissed after accepting £150 in cash from the father of a legally aided client, and both the initial decision and the EAT’s judgment attracted comment in the legal press [see links below]. The Court of Appeal gave a clear reminder of the limits on the EAT’s jurisdiction, and emphasised the importance of reading the judgments of specialist tribunals such as the Employment Tribunal in the round before concluding that there has been a misapplication of the law.
