Robin Allen KC and Dee Masters contribute to the drafting of the EU AI Act Code of Practice

In recognition of their leading work on AI regulation through the AI Law Consultancy at Cloisters, Robin Allen KC (working with Dee Masters) attended the first plenary of the EU’s working group for the drafting of the EU AI Act’s Code of Practice on 30th September 2024.

Together they will continue to contribute to its future work as one of only 13 groups selected from the UK.

Although the EU AI Act became the world’s first major regulation of Artificial Intelligence on 1st August 2024, it will take two years before all the major provisions are implemented. The Act requires codes of practice to secure this; Recital 117 to the Act saying -

"The codes of practice should represent a central tool for the proper compliance with the obligations provided for under this Regulation for providers of general-purpose AI models. Providers should be able to rely on codes of practice to demonstrate compliance with the obligations."

Accordingly, during those two years the European Commission through the AI Office will oversee the drafting of the first of the Codes of Practice saying that the -

“Code of Practice aims to facilitate the proper application of the AI Act's rules for general-purpose AI models, including transparency and copyright-related rules, systemic risk taxonomy, risk assessment, and mitigation measures.”

To ensure this Code sets an internationally recognised benchmark for AI regulation, the Commission has selected an international panel of contributors to its drafting, to which Robin and Dee will contribute.

The drafting of the Code will involve four sub- working groups meeting three times to discuss the drafts between now and April 2025. The final version will be published and presented in a closing plenary, expected in April 2025.
